THE AMENDMENTS
Serbian Parliament adopted the set of amendments to the judicial laws, i.e. following amendments:
• Amendments to the Law on Organization of Courts • Amendments to the Law on the Seats and Territorial Jurisdiction of Courts and Public Prosecutor’s Office • Amendments to the Law on Judges • Amendments to the Law on Public Prosecution
The most important changes brought about by this set of laws is the territorial organization of the courts. Laws introduced a significantly higher number of basic courts.
Furthermore, the exclusive territorial jurisdiction of the High Court in Belgrade has been established for following disputes:
• regarding the ban on distribution of press and information dissemination in the media
• disputes regarding the publication of the correction of the information and responses to information and Compensation for Damage in connection with the publication of information
• disputes concerning copyright and related rights and the protection and use of inventions, industrial designs, models, patterns, trademarks, geographical indications, integrated circuit topography, topography of semiconductor products and plant breeders
The above means that, when there is subject matter jurisdiction, these cases shall always be in High Court in Belgrade in these cases.
The exclusive territorial jurisdiction of the Commercial Court in Belgrade has been established for following disputes:
• disputes concerning copyright and related rights and the protection and use of inventions, industrial designs, models, patterns, trademarks, geographical indications, integrated circuit topography, topography of semiconductor products and plant breeders
The above means that, when there is subject matter jurisdiction, these cases shall always be in Commercial Court in Belgrade in these cases.
