Draft of the Law on Civil Partnerships
At the start of September this year, the draft of the Law on Civil Partnerships was once again a topic during the National Assembly’s procedure. However, since this was not the first time the draft was discussed at the Assembly (previously, it was during September last year), we expect that the enforcement of this Law still has a long way to go.
This regulation would legally govern same-sex marriages in the Republic of Serbia, i.e., the union between two adult persons of the same sex, the establishment and termination conditions, the partnership registry, and the effects and legal consequences of said union, which is referred to as “civil partnership”.
The Law would regulate the rights to maintenance and property relations among partners, the possibility of inheritance, taxes and other benefits, rights in case of illness, rights related to health, pension, and social insurance, and other rights, all in the manner of married partners. Additionally, alongside registered partnerships, there would be unregistered partnerships, subject to regulations pertaining to common-law unions.
As its predecessors, this proposition of same-sex marriage regulation didn’t include a proposition for allowing same-sex partners to adopt children
