Within the Collected Papers of the Faculty of Law in Novi Sad, issue 1/2025, Jelena Plamenac, senior attorney at law and manager of the civil law department, had her scientific paper on the subject of the legal framework for the protection of the family home published, with special focus on French legislation, as well as the legislation of Republika Srpska.

Namely, rights which specifically regulate the protection of family homes do not exist within domestic law. However, this paper analyses provisions of Family Law, as well as substantive law regulations, which essentially provide protection for the family home within our legal system and judicial practice. Furthermore, through the analysis of comparative legal systems, it is examined whether it would be advisable to include provisions related to specific protection of the family home in domestic legislation, or whether the existing provisions are sufficient.

Special attention is given to solutions found in French legislation, where the protection of this legal institution is highly developed. The main idea behind this topic lies in the fact that within family law of Republika Srpska in 2023, the protection of the family home was introduced as a special legal institute, making Republika Srpska the pioneer in the region in terms of prescribing special protection of the family home.
